Participant Waiver, Release of Liability & Assumption of Risk

This waiver is intended to be accepted electronically during the online ticket purchase process and does not require an in-person signature. By clicking “I Agree” and completing your purchase, you confirm that you have read, understood, and accepted these terms.

1. Acknowledgement of Risk

I acknowledge that participating in the Pilates & Prosecco event, including the Pilates mat class and any related activities, involves inherent risks, including but not limited to muscle strains, sprains, falls, dizziness, dehydration, aggravation of pre-existing conditions, serious injury, permanent disability, or death.

I understand that these risks cannot be completely eliminated, even when reasonable precautions are taken.

2. Medical Fitness

I certify that:

• I am at least 19 years of age.
• I am physically fit to participate in a Pilates class.
• I have consulted with my physician if I have any medical condition that may affect my ability to participate.
• I am not aware of any medical condition that would make my participation unsafe.

I agree to stop exercising immediately and notify the instructor if I experience pain, dizziness, shortness of breath, or any other concerning symptoms.

3. Voluntary Participation

I understand that participation is entirely voluntary.

I choose to participate at my own risk and accept full responsibility for my health, safety, and wellbeing during the event.

4. Release and Waiver of Liability

In consideration of being permitted to participate in Pilates & Prosecco, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and hold harmless:

• Pilates & Prosecco Co.;
• the event organizers;
• the Pilates instructor(s);
• volunteers;
• sponsors;
• venue owners and operators;
• employees, contractors, representatives, affiliates, successors, and assigns;

from any and all claims, demands, actions, causes of action, damages, losses, costs, expenses, or liabilities arising out of or relating to my participation in the event, including personal injury, illness, property damage, or death, except where caused by gross negligence or willful misconduct to the extent permitted by applicable law.

5. Assumption of Risk

I knowingly and freely assume all risks associated with participating in the Pilates class and any related event activities, whether known or unknown.

6. Alcohol Acknowledgement

I understand that alcoholic beverages may be served after the Pilates class.

I agree that:

• consumption of alcohol is entirely voluntary;
• I will consume alcohol responsibly;
• I will not participate in physical activity while impaired;
• I am responsible for arranging safe transportation if I consume alcohol.

I release the Released Parties from any liability arising from my voluntary consumption of alcohol, except where prohibited by law.

7. Personal Property

I understand that I am solely responsible for my personal belongings and that the Released Parties are not responsible for any lost, stolen, or damaged property.

8. Photography & Media Release

I understand and agree that photographs, audio recordings, and video recordings may be taken during the event.

By attending the event, I knowingly and voluntarily consent to being photographed, filmed, and recorded, and I grant Pilates & Prosecco Co. permission to use my image, likeness, voice, and any photographs, audio recordings, or video recordings of me for promotional, marketing, advertising, social media, and other business purposes without compensation.

I understand that attendance at the event constitutes my full and unconditional agreement to this Photography & Media Release.

9. Emergency Medical Care

In the event of an emergency, I authorize the organizers to obtain medical treatment on my behalf if I am unable to provide consent.

If I choose to provide an emergency contact, I authorize the organizers to contact that person. I understand that providing an emergency contact is optional but recommended.

I understand that I am solely responsible for any medical expenses incurred.

10. COVID-19 and Communicable Illness

I acknowledge that participating in public events may expose me to communicable illnesses.

I voluntarily assume this risk and agree not to attend if I am experiencing symptoms of illness or have been advised to isolate.

11. Indemnification

I agree to indemnify and hold harmless the Released Parties from any claims, liabilities, damages, costs, or legal fees arising from my actions, negligence, or breach of this agreement.

12. Governing Law

This agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

13. Severability

If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

14. Electronic Acceptance

I have carefully read this Waiver and Release of Liability.

I understand its contents, understand that I am giving up certain legal rights, including the right to sue, and I agree to be bound by its terms.

I understand that my electronic acceptance, including checking the box below and completing my ticket purchase, has the same legal effect as a handwritten signature.
